ASupreme Court bench consisting of Justices Dipankar Datta and A.G. Mashi is due to hear a petition scheduled on July 28 filed by Allahabad HC judge Justice Yashwant Varma.

The petition challenging the in-house inquiry procedure and the subsequent recommendation of then Chief Justice of India Sanjiv Khanna, for his removal from office, in connection with the allegation that the half-burnt currency was found in his residential premises in Delhi on the intervening night of March 14-15.

Senior advocate Kapil Sibal, who made an oral mention for an early hearing of the petition, said the petition has raised several constitutional issues with respect to the recommendation made by former CJI Khanna (now retired) for the removal of Justice Varma.

Delhi High Court Justice Yashwant Varma’s judicial work was withdrawn after cash was allegedly found in his property after a fire broke out on March 14. This led to the Supreme Court Collegium announcing his transfer to the Allahabad High Court. 

The row brought to the fore discussions about judicial accountability. Congress MP Jairam Ramesh raised the issue in the Rajya Sabha on March 21, and Chairman Jagdeep Dhankhar assured him that he will find a way to hold a structured discussion on the issue.

    Lok Sabha to take up motion to remove Justice Varma, motion not admitted in Rajya Sabha

    Lok Sabha will take up a bipartisan motion to remove Justice Yashwant Varma, who is embroiled in a suspected corruption case, as the opposition-sponsored notice for a similar motion in Rajya Sabha was not admitted. 

    Parliamentary Affairs Minister Kiren Rijiju said on Friday (July 25, 2025) that it was a unanimous decision of all political parties to move unitedly in a case of perceived corruption in judiciary, asserting that Lok Sabha will take up the motion, which was signed by 152 MPs from the ruling alliance and the Opposition. 

    Official sources said the Opposition-sponsored notice for a similar motion in Rajya Sabha, which received it on the same day when the bipartisan notice was submitted to Lok Sabha on July 21, has not been admitted. 

    This ends speculation about the fate of the notice signed by 63 Rajya Sabha members of Opposition parties. Then Rajya Sabha Chairman Jagdeep Dhankhar had mentioned receiving it in the House, alarming the government and triggering a chain of events that led to his abrupt resignation on the same night. 

    Mr. Rijiju said all political parties had agreed that the removal of Varma should be a joint call, adding that the proceedings will be taken up in Lok Sabha and then move to Rajya Sabha in line with the Judges (Enquiry) Act. — PTI

    CJI agrees to constitute Bench to hear plea on behalf of Justice Varma

    Chief Justice of India B.R. Gavai on Wednesday (July 23, 2025) said he will constitute a Bench for hearing a petition filed on behalf of Allahabad High Court judge, Justice Yashwant Varma, challenging the in-house inquiry procedure and the then Chief Justice Sanjiv Khanna’s recommendation to the President and Prime Minister, in the month of May, to remove the judge from office.

    The Chief Justice said he, however, would not be part of the Bench.

    Cash discovery row: Piles of currency notes found in Justice Varma’s gutted storeroom, says inquiry committee report

    An in-house inquiry committee constituted by the Chief Justice of India concluded that cash was found in the gutted storeroom at the official residential premises of High Court judge, Justice Yashwant Varma, and police and fire authorities were “slipshod” in not lodging an FIR or preparing a seizure memo recording exactly what they came across at the scene of the fire on March 14-15.

    The committee said the “higher police officials” had sought to explain their inaction by pointing to reasons like the “sensitivity of the issue” and the absence of Justice Varma at his residence at the time of incident. Justice Varma and his wife were in Bhopal on a holiday trip on the night of the fire.

    Allahabad High Court judge, Justice Yashwant Varma, said on Friday (July 18, 2025) that the Supreme Court’s in-house inquiry process, which recommended his removal from office, is a “parallel, extra-constitutional mechanism” designed for the judiciary to usurp the Parliament’s exclusive authority.

    An in-house inquiry committee of three judges constituted by the then-Chief Justice of India, Justice Sanjiv Khanna, had confirmed that unaccounted cash was found in the gutted storeroom at Justice Varma’s official residence after a blaze on March 14 and 15 this year. Chief Justice Khanna (now retired) had forwarded the report to the Prime Minister and President in May after Justice Varma had refused to resign.

    Supreme Court says Delhi High Court judge’s transfer is not related to ‘rumours’

    The Supreme Court issued a statement on Friday (March 21, 2025) that “misinformation and rumours” are being spread with regard to an “incident” at the residence of Delhi High Court judge, Justice Yashwant Varma, compelling the apex court Collegium to transfer him out. 

    The statement from the Supreme Court came after a report by The Times of India, followed by source-based online media reports, that a “huge pile of cash” was recovered when a fire broke out in the residential bungalow of the judge. 

    The press note issued by the Supreme Court, while confirming the existence of a proposal to transfer Justice Varma, stated categorically that it was unconnected with an in-house enquiry procedure into the “incident”.
